Colorado Mom Gets a Scarlet M
In Ft. Collins-- a really disturbing story of a woman who was convicted of giving her 19-year-old son marijuana in a brownie and then he jumped out of a 3rd story window. [Click paragraph to go to story on Channel 7]
The problem is at least two-fold: we need to get away from criminalization AND marijuana is NOT as safe as we would like to believe, and a lot of it depends on dosage, method of delivery -- AND we're NOT even sure about all this stuff. Branding this woman with a figurative Scarlet M [30 days in jail, 2 years probation] -- is morally bankrupt AND pretending marijuana isn't more complicated than we thought is getting us into all kinds of ethical dilemmas. Now part of this was that the son was not of age -- he was 19 -- not 21 -- but was that really the operative factor in this disturbing incident? Or was it just the marijuana in the brownies? Our understanding is the State is going to use some of its marijuana tax money for marijuana research which we applaud. In the meantime, we recommend further minimizing criminalization and maximizing a medical approach as well as possible legal products liability claims against marijuana sellers. We believe Courts should NOT allow marijuana sellers off the hook on a defense of "assumption of the risk" because we believe that to be clearly against public policy.
